Form FDA 483
At the end of an inspection the FDA presents Form 483 to senior management and discusses it 1. It notifies management of objectionable conditions. Companies are encouraged to respond in writing with a corrective action plan and carry it out quickly 1. The form is not a final agency determination. The FDA weighs it with the establishment inspection report, evidence collected and any company response 1.
The FDA publishes spreadsheets of areas of regulation cited on system-generated 483s by fiscal year, from FY 2006 to FY 2025 5. The agency says these are not a full list, as some 483s are prepared by hand 5.
The warning letter
Chapter 4 of the Regulatory Procedures Manual says warning letters are issued to achieve voluntary compliance and to establish prior notice 2. A warning letter communicates the agency's position but does not commit the FDA to enforcement action 2. The FDA has no legal obligation to warn before taking enforcement action 2.
The letter includes a request for correction and a written response within a set period, usually 15 working days after receipt 2. The FDA's public page says the letter gives the recipient a chance to address the concerns. A recipient who disagrees can supply its reasoning and supporting information 3.
Internal FDA timelines
If a Form 483 response arrives during legal review of a draft letter, the review clock stops and restarts once counsel receives the response and the program's assessment 2.
| Step | Target |
|---|---|
| Program submits a warning letter recommendation | 15 working days after the inspection or evidence 2 |
| Center reviews the recommendation | 15 working days 2 |
| Chief Counsel review where required | 15 working days 2 |
| Follow-up inspection | About 30 days after the response 2 |
| Close-out letter | Within 65 working days of having the information 2 |
Who receives a letter
Warning letters go to the party responsible for the violation, and the issuing office must identify that party first 2. The FDA may write to importers, owners or consignees of regulated imports. A letter to a customs broker is not usually appropriate, except where the broker is itself the owner, consignee or importer, or has authority over the product 2. A foreign firm may receive one where the FDA has regulatory authority over it and is prepared to use it 2.
A second warning letter for the same or similar violations should not usually be issued, though the manual allows one in some situations to establish prior notice 2. If violations are seen at a later inspection, the FDA says enforcement action may follow without further notice 3.
Close-out and publication
A close-out letter is not issued on promises. The corrections must be made and verified, usually by a follow-up inspection 3. No close-out letter issues where the violations cannot be corrected 3. The programme applies to warning letters issued on or after 1 September 2009 3.
Warning letters are posted on fda.gov. The FDA removes them only if it rescinds or amends them 2. A recipient may ask the FDA to post its response, which is redacted under the Freedom of Information Act before posting 2. The FDA warning letter database can be filtered for letters with response or close-out letters 4. The FDA notes that later contact may have changed the status of matters in a letter 4.
